BELOW is a copy of our generic equipment rental and waiver agreement. You’ll need to run this past an attorney familiar with the liability laws in your municipality. For now it’s a really great starting point so you don’t miss any basic language.

Sample  Equipment Rental & Waiver Agreement

Signature below acknowledges that renter has read and understood all aspects of this document. Renters are responsible for all riders in their party.

DEPOSIT

-A credit card and valid driver license or passport is required in addition to a rental deposit of ________________.

PARTICIPANT AGE AND HEALTH

-Primary renter must be at least 18 years of age.
-Infant participants must be at least 1 year old and be able to hold their head and upper body in an upward position and be able to wear a helmet.
-Participants must be in good health, and able to operate, control and balance the equipment at time of rental. Please consult your physician if you are unsure.

HELMETS

-Helmets are provided free with rental.
-Participants under the age of 18 must wear a helmet.
-Participants 18 years and older must comply with local helmet laws which state ________________.

RENTAL PERIOD RESPONSIBILITIES

-Locks are provide free with rental.
-Equipment must be locked to a rigid fixture any time renter or rider in renter’s party not using the equipment.
-Participants are responsible for the rental equipment, from the time the equipment is rented until the time it is returned, including damage and theft of rental equipment.

RELEASE of RENTAL COMPANY FROM LIABILITY and RENTAL AGREEMENT DETAILS

Please read carefully before signing:

I accept for use the equipment listed on this form and accept full responsibility for the care of this equipment.

I understand that bicycling can be a hazardous activity. I understand that the sport of bicycling and the use of this equipment involve a risk of injury to any and all parts of the user’s body or death. I hereby agree to freely and expressly assume and accept any risks of injury or death of the user of this equipment while bicycling. I understand that bicycle protective gear such as helmets and gloves are recommended, but they do not eliminate the risk and may not reduce the risk of injury in the event of an accident.
I agree that I will release this rental company from any and all responsibility of liability for injuries or damages to the user of the equipment listed on this form or to any other person. I agree not to make a claim against or sue this rental company for injuries or damages relating to bicycling or the use of this equipment.

The equipment, at all times, remains the exclusive property of the rental company. The renter is responsible for damage to or loss of the equipment. If the equipment is lost, destroyed or damaged beyond repair in the judgment of the rental company, the renter agrees to pay the company the value of the bicycle or equipment as indicated on the list of fees for lost, damaged, or stolen equipment. All repairs needed as a result of the use of the equipment will be performed at the normal labor rates and the cost of such repairs, including all parts, shall be paid by the renter.
